Ban and penalties for corrupt hires
If enacted, the bill would bar anyone with a final conviction for bribery, certain ethics crimes, or a FARA offense from holding confidential or policy-making executive branch jobs for 10 years after conviction. The ban would cover Schedule C positions (or a successor rule) and would take effect 90 days after enactment. Before starting, candidates would have to sign a written certification under penalty of perjury; OPM would issue guidance within 90 days and keep the forms at least 10 years. Agencies or OPM would have to remove anyone found barred within 30 days and refer cases to Inspectors General, the Office of Special Counsel, or the Department of Justice. Individuals who serve in violation could face a civil penalty up to $100,000 for each day of unlawful service, and OPM could assess a separate $50,000 fine (waived if the person resigns within 90 days of the determination).
