Securing Elections From AI Deception Act

Sponsored By: Representative Brown, Shontel M. [D-OH-11]

Introduced

Summary

Stops AI-driven voter deception. This bill would bar the use of advanced algorithms to deprive, defraud, intimidate, or coerce voters and election workers and would force clearer labeling of AI election content.

Show full summary
  • Voters and election workers: It would make using covered algorithms to lie about voting times, places, eligibility, ballot counting, endorsements, or to intimidate or interfere with registration and voting a crime punishable under title 18, with fines or up to 1 year in prison.
  • Developers and deployers: Developers would face a legal "Duty of Care" to make covered algorithms safe and effective. Deployers must add clear disclaimers on synthetic candidate imagery or voting information, for example the explicit text "AI Disclaimer: This output was generated by artificial intelligence" or an "AI" symbol, and developers must give tools to include those labels and make them hard to remove when feasible. The Federal Trade Commission must write detailed rules within 2 years.
  • Oversight and outreach: The Federal Trade Commission would enforce the disclaimer and duty-of-care rules under its unfair practices authority with FTC-aligned penalties. The bill also requires a 5-year public education program and a report to Congress on disclaimer use and effectiveness.

Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

Ban on AI voter deception

If enacted, the bill would ban intentionally using AI or similar covered algorithms to deprive or defraud someone of the right to vote in Federal, State, or local elections. The ban would cover lies or altered content about voting times, places, methods, eligibility, ballot counting, endorsements, and other material voting information. It would also bar algorithm-assisted threats, intimidation, fraud, or coercion to stop someone from registering, voting, supporting a candidate, or serving as an election worker. Violations would carry fines or up to 1 year in prison. This prohibition would take effect 60 days after enactment.

Mandatory AI labels for election media

If enacted, the bill would require a deployer to attach an AI disclaimer when publishing media that simulates or alters a candidate's image, video, or voice, or when depicting voting or voter-registration information. The disclaimer must be either the exact text "AI Disclaimer: This output was generated by artificial intelligence" or an "AI" symbol in a circle. Developers that offer the capability must give deployers a way to add the disclaimer and, where technically feasible, make the disclaimer permanent or hard to remove. The FTC would write rules within 2 years and the labeling rules would start 60 days after those rules. The FTC could exempt media a reasonable person would recognize as synthetic, would enforce violations under the FTC Act, and would run a 5-year public education program and report to Congress on adoption and effectiveness.

Safety rules for AI election tools

If enacted, the bill would require developers and deployers to offer, license, and use covered algorithms in a safe and effective way. To meet the safety test, they would need reasonable steps to address harms found in pre-deployment evaluations or impact assessments and to check whether intended uses could cause violations or substantial harm. To meet the effectiveness test, they would need reasonable steps to ensure performance matches advertised purpose and uses relevant data for the deployment context. The FTC would enforce these requirements under its unfair or deceptive practices authority.
