  • Families and children: Parents and a child who can express an opinion would be entitled to a written notice explaining the placement within 90 days of the decision. The child's attorney could ask a court to review the placement decision.
  • Relatives and guardians: Any relative who has said they are interested in caring for the child, the child's guardian, and the guardian ad litem would get notice and could request written documentation of the reasons within 5 days of receiving the notice.
  • Attorneys and courts: The bill would let the child's attorney petition the court to review the decision. Courts would have to start that review within 7 days of the petition and hold the review on the record.
  • States and timing: The rules would take effect on the first day of the first fiscal year after enactment and apply to Title IV-E quarter payments starting then. If a state needs new laws to comply, its plan would not be treated as noncompliant until the first quarter after the state legislature's first regular session, with two-year sessions treated as separate years.
