Summary

Would stop safety-net providers from paying more than the 340B ceiling price at the point of purchase. The bill would add an upfront pricing rule to the 340B statute and require the HHS Secretary to account for that limit when evaluating manufacturer agreements.

  • Safety-net covered entities named in 340B(a)(4), entities that receive funds directly from a state or local government, and sole community hospitals would be protected from upfront overpayments.
  • Drug manufacturers would be barred from making agreements that charge those safety-net entities above the applicable 340B ceiling price at purchase, even if later rebates or reconciliations would occur.
  • The HHS Secretary would be required to apply the new upfront pricing constraint when determining whether existing agreements with manufacturers meet 340B requirements.
