Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Mandatory safety testing for imported cannabinoids

If enacted, Customs and Border Protection, working with the FDA, would require testing of imported cannabinoid products meant for human consumption. Tests would check for lead, cadmium, mercury, arsenic, mold and mycotoxins, pesticides, microbial contamination, residual solvents, and synthetic byproducts or unknown compounds. CBP and the U.S. International Trade Commission would publish annual aggregate import data and testing and refusal information by country, cannabinoid type, quantity, and value.

Higher tariffs and import rules for cannabinoids

If enacted, the bill would add a 50 percent extra duty on hemp-derived cannabinoid products originating in China. The President would direct the U.S. International Trade Commission to create separate tariff headings for isolates, distillates, natural, synthetic, and chemically altered cannabinoids. The bill would also set definitions (for example, an isolate must be at least 85% of a single cannabinoid) and let Customs require extra import information or certifications to stop evasion. The extra duty would apply to entries made 90 days after enactment.
