Bill Overview

Analyzed Economic Effects

3 provisions identified: 3 benefits, 0 costs, 0 mixed.

Protect 340B pharmacies and patients

If enacted, group health plans, health insurers, and pharmacy benefit managers would be banned from treating 340B covered entities or specified contract pharmacies differently. They would have to pay or contract the same as similarly situated non-340B providers and could not deny drug coverage or block a patient’s choice of pharmacy because of 340B status. The rule would also apply to Medicare Part D sponsors and their PBMs. The Secretary would be required to penalize PBMs that break these rules, up to $5,000 per violation per day, and issue proposed rules within 60 days and final rules within 180 days after enactment.

Block federal changes to 340B

If enacted, the Secretary would have to end the 340B Rebate Model Pilot Program on the date of enactment, including the program described in the August 8, 2026 Federal Register notice. The bill would also bar the Secretary from starting any substantially similar program later. It would forbid using any appropriated funds to implement Executive Order 13937 (July 29, 2020) or to set or limit what a 340B covered entity may charge patients for 340B drugs.

Prevent duplicate Medicaid discounts

If enacted, HHS would hire a conflict-free contractor within one year to review confidential claims-level data and spot 340B drug claims that were wrongly included in State Medicaid rebate submissions. Covered entities and States would have to provide requested data. States would have to remove claims flagged by the contractor from rebate requests, and the contractor would notify the State and the Secretary for remedy.
