Fair Disaster Assistance Act of 2025
Sponsored By: Representative Garcia, Robert [D-CA-42]
In Committee
Summary
Prevents premature denials of FEMA disaster aid when an insurance claim is still pending. This bill would require the FEMA Administrator to issue regulations so an applicant who indicates ownership of an insurance policy does not receive a notice denying assistance under section 408 of the Stafford Act before a final determination is made on the applicant’s insurance claim. It targets the timing of FEMA denial notices for damage from a major disaster declared under section 401 and does not create new funding or change eligibility rules.

No early FEMA denials for insured homeowners
If enacted, FEMA would not be able to send a denial letter before your insurer makes a final decision. This would apply when you apply for FEMA help after a declared major disaster and you say you have insurance on the damaged home or facility. It would not guarantee approval or more money; it only changes the timing of denial notices. This would start upon enactment.
