Protecting Privacy in Purchases Act

Sponsored By: Representative Moore, Riley M. [R-WV-2]

Passed House

Summary

Stops payment systems from assigning merchant codes that single out firearms sellers. The bill would bar payment card networks and covered entities from requiring or assigning merchant category codes that identify retailers as selling firearms, ammunition, accessories, or components.

Show full summary
  • Firearms retailers — would not be assigned MCCs used only or primarily for firearms sellers, removing a discrete code that labels their transactions.
  • Consumers — purchases at firearms retailers would be less likely to be automatically tagged by payment codes as firearm-related, limiting that avenue for transaction classification.
  • Payment card networks and covered entities — would be prohibited from requiring or assigning firearms-specific MCCs and must follow the new restrictions.
  • Enforcement and oversight — the Attorney General must create a complaints process within 90 days, require remedies within 30 days of notice, may seek federal injunctions for unresolved violations, and must report to Congress annually. The bill creates no private right of action.
  • Federal preemption — it would preempt state and local laws regulating these specific MCC practices while allowing compliance with laws on fraud, dispute processing, and transaction integrity.

Bill Overview

Analyzed Economic Effects

3 provisions identified: 3 benefits, 0 costs, 0 mixed.

National rule on gun-store codes with exceptions

This bill would set one national rule for merchant codes tied to gun sellers. States and cities would not be able to set or enforce their own firearm‑specific code rules. Networks and processors would still be able to follow fraud, dispute, and data‑security laws, even if those steps touch merchant codes. These changes would take effect at enactment.

No special card codes for gun stores

This bill would bar payment card networks and processors from using merchant codes that single out gun stores. They would not be able to require or assign a code used only, or mainly, for firearms sellers or that marks sales of guns, ammo, parts, or accessories. The rule would apply to current and new processing relationships, starting at enactment. The bill would define who counts as a covered entity, a payment card network, a firearms retailer, and a merchant category code.

Report merchant code violations to Justice

The Attorney General would run enforcement. Within 90 days of enactment, the Justice Department would open a complaint process. Anyone, including firearms retailers, would be able to file complaints. The AG would investigate and order fixes within 30 days of notice. If a company does not fix it, the AG would seek a federal court injunction. The bill would not let private parties sue. Each year, the AG would report investigations and results to Congress.
