Purchased and Referred Care Improvement Act of 2025
Sponsored By: Representative Johnson, Dusty [R-SD-At Large]
Introduced
Summary
Guaranteed 30-day reimbursement for out-of-pocket purchased/referred care is the bill's core aim. It would shift financial responsibility away from patients for Indian Health Service purchased/referred care and create a clear, timebound process and consistent terminology.

- Patients and families: would be protected from liability to providers or debt collectors for IHS-authorized purchased/referred care and could be reimbursed for out-of-pocket payments within 30 days after submitting required documentation in person or electronically.
- Indian Health Service and providers: would have to establish reimbursement procedures within 120 days and update the Indian Health Manual, provider contracts, and related guidance within 180 days. The bill also replaces the phrase "contract health service" with "purchased/referred care" across the statute.
- Tribal programs: reimbursements would not cover purchased/referred care furnished under a tribe's Self-Determination compact or contract unless the tribe expressly agrees to participate.

No patient bills for Indian Health Service care
If enacted, patients using Indian Health Service purchased or referred care would not owe these bills to providers or debt collectors. This would hold even if a patient signed a form agreeing to pay. If you already paid for approved care, the Service would reimburse you within 30 days after you submit documents. The Secretary would set the process within 120 days and accept documents online or at a Service facility. These rules would apply to care given on, before, or after enactment, but Tribal ISDA programs would be covered only if the Tribe agrees.
