It would preserve the Countermeasures Injury Compensation Program and the National Vaccine Injury Compensation Program and let people sue even if they sought or received compensation, and it would apply retroactively while using FDA approval or authorization to define "COVID-19 vaccine".
- Manufacturers: Companies that make COVID-19 vaccines would face ordinary civil liability and could not be shielded by new or existing federal immunity or liability cap provisions.
- People harmed by vaccines: Individuals could pursue damages in court and could still seek payments from the Countermeasures Injury Compensation Program or the National Vaccine Injury Compensation Program.
- Scope and timing: The bill would cover vaccines licensed or authorized by the Food and Drug Administration and would apply to vaccine administrations both before and after enactment.

Allow lawsuits against COVID vaccine makers
This bill would let people sue COVID-19 vaccine makers for harms from an FDA-authorized or licensed COVID-19 vaccine. It would remove federal immunity or caps that block these lawsuits. You could still seek money from the Countermeasures Injury Compensation Program or the National Vaccine Injury Compensation Program. You would not lose your right to sue just because you applied for or received those benefits. It would cover vaccines given before, on, or after the bill becomes law.
