Gun Trafficker Detection Act

Sponsored By: Representative Casten, Sean [D-IL-6]

Introduced

Summary

mandatory reporting of lost or stolen firearms is at the center of this bill. It would force non-licensed gun owners to report a lost or stolen firearm quickly, create a federal web portal for reports, and add civil fines and temporary transfer bans for repeat offenders.

Show full summary
  • Owners who are not federally licensed would have to report a stolen or lost firearm to the Attorney General within 48 hours using the web portal. If they do not use the portal they must also notify local law enforcement, and penalties start at up to $1,000 for a first violation and up to $5,000 for later violations.
  • People hit with repeated civil penalties face temporary limits on acquiring firearms: two penalties bar receipt for 1 year and three penalties bar receipt for 5 years.
  • The Attorney General would have 180 days to create the portal and must notify local chiefs within 72 hours after a portal report arrives. The bill would also require NICS (the National Instant Criminal Background Check System) rule changes within 6 months, require dealers to warn unlicensed buyers about the penalties, and push certain grant applicants to devote at least 5% of grant funds to managing lost or stolen firearm data unless certified otherwise.

Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 2 costs, 0 mixed.

New 48-hour reporting for lost or stolen guns

This bill would require unlicensed gun owners to report a lost or stolen gun within 48 hours, if the gun moved in interstate or foreign commerce. The Attorney General would build a web portal within 180 days to take these reports and warn about penalties for false statements. If you do not use the portal, you would also need to tell local police. After a portal report, the Attorney General would notify the local chief of police within 72 hours. If you fail to report, you could face a civil fine: up to $1,000 the first time and up to $5,000 after that, after notice and a chance for a hearing.

Repeat violators could face gun-buying bans

If enacted, people who twice receive civil penalties for not reporting a lost or stolen gun would be barred from receiving a firearm for 1 year. Three penalties would trigger a 5-year ban. Within 6 months, the Attorney General would update background-check rules so this ban appears in the system. Licensed gun dealers would also have to tell unlicensed buyers about the penalties for failing to report lost or stolen guns.

Set aside grants for lost-gun data

Applicants for certain federal public safety grants would have to spend at least 5% of each year’s award on managing and collecting data on lost or stolen guns. They would not have to do this if the Attorney General certifies they already forward every such report to the national crime database (NCIC).
