Sponsored By: Representative Fitzpatrick, Brian K. [R-PA-1]

Introduced

Summary

Nonpartisan independent redistricting commissions would be required to draw congressional districts starting with the maps tied to the 2020 census. The bill would also tie federal election-administration funding to states' use of such commissions for state legislative redistricting.

Show full summary
  • States: To receive any federal funds for election administration a state would have to certify to the Election Assistance Commission that it conducts state legislative redistricting, beginning with the first redistricting after enactment, using a nonpartisan independent commission.
  • Voters and representation: Congressional redistricting would be handled under commission plans starting with the 2020 decennial census. A qualifying commission would have equal numbers of members affiliated with the largest and second-largest registered-voter parties and none of its members could be an elected public official.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Independent commissions draw House maps

If enacted, the bill would require each State to use a nonpartisan independent commission to draw U.S. House (congressional) districts. This would start with the redistricting done using the 2020 census. A qualifying commission would have equal numbers of members affiliated with the two largest parties (based on the most recent statewide federal election) and none of its members could be an elected public official.

Federal election funds tied to maps

If enacted, the bill would bar a State from using any Federal funds provided directly for election administration unless the State certifies to the Election Assistance Commission that it conducts State legislative redistricting using a nonpartisan independent commission. The certification requirement would apply beginning with the first State legislative redistricting carried out after this Act is enacted. Failure to certify could put federal election-administration funds at risk and affect how elections are funded and run in the State.
