Protecting International Pipelines for Energy Security Act

Sponsored By: Representative Walberg, Tim [R-MI-5]

In Committee

Summary

Prevents the President from revoking permits for cross-border oil, natural gas, and electric transmission projects unless Congress approves a revocation. It bars the executive branch from canceling permits or authorizations issued under several specified Executive Orders and ties coverage to the border-crossing portions of pipelines and transmission lines.

Show full summary
  • Energy developers and project owners: Keeps permits and related authorizations for international pipeline and transmission projects from being overturned by the President alone, increasing permit stability for cross-border projects.
  • The President and federal agencies: Removes the executive branch's authority to revoke permits issued under the named Executive Orders unless an Act of Congress specifically allows a revocation.
  • Congress and lawmakers: Requires Congress to pass a law to authorize any revocation, shifting final control over permit cancellations to legislators.
  • Legal and regulatory clarity: Defines "border-crossing facility" and references the Natural Gas Act definition of natural gas to specify which projects are covered and reduce ambiguity.

Limits on revoking cross-border energy permits

If enacted, this would stop the President from revoking cross-border energy permits without a new law from Congress. It would cover permits for oil and natural gas pipelines and electric transmission lines at the U.S. border. The rule would apply to permits issued under existing executive orders, such as Executive Orders 13337, 11423, 12038, and 10485. “Oil” would mean petroleum or a petroleum product, and “natural gas” would follow the Natural Gas Act. It would take effect when signed into law.
