Security Clearance Review Act

Sponsored By: Representative Beyer, Donald S. [D-VA-8]

Introduced

Summary

Centralizes final security-clearance and classified-access decisions for White House political appointees and special government employees with the FBI Director. This bill would require FBI-made denials, suspensions, or revocations to trigger immediate notice to the President and to Congress and would force a written explanation if the President overturns an FBI decision within 30 days.

Show full summary
  • Political appointees and special government employees: Would bar employment, detailing, or assignment to the Executive Office of the President unless the arrangement is clearly consistent with national security and the FBI Director grants the clearance or access decision.
  • President and Congress: Would require the FBI Director to notify the President and appropriate congressional committees on the date of any denial, suspension, or revocation. If the President reverses or fails to recognize an FBI determination the President must send a written explanation to those committees within 30 days.
  • FBI and accountability: Would make the FBI Director the central decision point for these EOP clearances, and relies on existing statutory definitions for who counts as a political appointee or special government employee.

FBI would decide clearances for White House appointees and advisers

If enacted, the FBI Director would make the final call on security clearances and classified access for White House political appointees and special government employees. These individuals could only work in, be detailed to, or be assigned to the Executive Office of the President if that is clearly consistent with national security. The FBI Director would have to tell the President and key congressional committees the same day a clearance or access is denied, suspended, or revoked. If the President overturns or ignores that decision, the President would have to send Congress a written explanation within 30 days. The bill uses existing legal definitions to decide who is covered and would override other clearance processes for this group.
