New Source Review Permitting Improvement Act

Sponsored By: Representative Griffith, H. Morgan [R-VA-9]

In Committee

Summary

Clarifies when changes at industrial sources count as a "modification" for New Source Review and Prevention of Significant Deterioration by tying the test to recent hourly emissions and narrowing construction triggers. The bill rewrites how regulators judge whether a change raises emissions and when preconstruction permits are required for major sources.

Narrower pollution permit rules for plants

If enacted, this bill would narrow when major industrial changes need New Source Review permits. It would use a 10-year lookback to compare maximum hourly emission rates before and after a change. A change would count as a modification only if the post-change maximum hourly rate exceeds any hour in the prior 10 years. Preconstruction permits would apply only when there is physical work on discrete parts of an emissions unit. Projects that lower emissions per unit or restore safety would not be treated as modifications. EPA could still require review if it finds the higher hourly rate would harm health or the environment. The bill would also bar treating a change as a modification if it would not have been one the day before enactment.
