Introduced

Summary

Strips legal force from EPA's greenhouse gas performance standards for fossil fuel-fired power plants. H.R. 1651 would declare that the EPA final rule titled "New Source Performance Standards for Greenhouse Gas Emissions From New, Modified, and Reconstructed Fossil Fuel-Fired Electric Generating Units; Emission Guidelines for Greenhouse Gas Emissions From Existing Fossil Fuel-Fired Electric Generating Units; and Repeal of the Affordable Clean Energy Rule" (89 Fed. Reg. 39798, May 9, 2024) shall have no force or effect. The bill includes no other operative provisions and does not add replacement standards, funding, or enforcement mechanisms, returning the regulatory status quo for that rule.

Cancel EPA power plant climate rules

This bill would cancel the EPA final rule at 89 Fed. Reg. 39798 (May 9, 2024). It would remove federal greenhouse gas limits and guidelines for new, modified, reconstructed, and existing fossil fuel power plants. The nullification would take effect upon enactment. If passed, this could lower compliance costs for power companies and change state planning. It could also raise emissions and may affect electricity prices for households.
