Justice for Vaccine Injured Veterans Act of 2025

Sponsored By: Representative Davidson, Warren [R-OH-8]

In Committee

Summary

Creates a presumption that certain illnesses linked to the COVID-19 vaccine are service-connected for service members who received the vaccine under orders between August 24, 2021 and January 10, 2023. It also requires regular public reporting on related VA claims and allows the VA to add other diseases if evidence supports a connection.

  • Veterans: Service members who developed listed conditions such as myocarditis, pericarditis, thrombosis with thrombocytopenia, or Guillain-Barré syndrome would be presumed to have service-connected conditions, which generally makes it easier to obtain VA disability compensation.
  • Department of Veterans Affairs and the public: The VA would publish reports every 60 days for a four-year period showing the total number of vaccine-related claims and the status of each claim by approved, denied, or under appeal.
  • VA leadership and Congress: The VA Secretary could designate additional diseases as covered when a positive association with the COVID-19 vaccine is found, and must notify the House and Senate Veterans’ Affairs Committees of any additions.
  • Legal definition: The bill defines “COVID-19 vaccine” to include vaccines licensed under the Public Health Service Act or authorized for emergency use by the Food and Drug Administration.

Easier VA disability for vaccine-injured veterans

If enacted, this would cover veterans and service members who got a COVID-19 shot under orders. The shot must be between August 24, 2021 and January 10, 2023. If a listed disease later appears, VA would presume it was service-connected, even without service records. Covered diseases are myocarditis, pericarditis, thrombosis with thrombocytopenia syndrome, and Guillain–Barré Syndrome. The VA Secretary could add more diseases with evidence and must notify the House and Senate Veterans' Affairs Committees. VA would report every 60 days for four years on claim counts and results, and post each report online. COVID-19 vaccine means a vaccine licensed or emergency-authorized in the U.S. to prevent COVID-19.
