  • Rural seniors and families: Would keep CMS from enforcing the new staffing and transparency rule, which changes how staffing levels and reporting would be set at local nursing homes.
  • Nursing homes and operators: Would bar adoption or enforcement of a federal minimum staffing standard and related reporting requirements, removing that potential federal mandate.
  • Nursing staff and policymakers: Requires HHS to appoint a 17-member panel within 60 days, hold public meetings with recordings and transcripts posted, deliver an initial report within 60 days after its first meeting, and publish annual updates. The panel must include rural nurses, aides, physicians, CMS and HRSA representatives and two state board of nursing reps.

Would block new nursing home staffing rule

This bill would stop HHS from putting into effect a final rule on nursing home staffing. It would apply to the rule titled "Medicare and Medicaid Programs; Minimum Staffing Standards for Long-Term Care Facilities and Medicaid Institutional Payment Transparency Reporting" published May 10, 2024 (89 Fed. Reg. 40976–41000). The block would start on the date of enactment and would also bar any substantially similar rule. Nursing homes would not need to meet a new federal minimum staffing standard or the related Medicaid payment transparency reporting in that rule. Facilities could avoid new hiring costs, but residents and families might not see staffing increases the rule aimed to require.
