CLEAN Act
Sponsored By: Representative Fulcher, Russ [R-ID-1]
Passed House
Summary
Speeds up geothermal leasing and forces quicker drilling-permit decisions. This bill would create annual lease sales, require replacement sales if a sale is canceled, and set short, enforceable timelines for permit reviews tied to NEPA.
Show full summary
- Geothermal developers and companies would see more frequent opportunities. Lease sales would occur every year instead of waiting at least two years, and a canceled or delayed sale must be replaced within the same year.
- Permit applicants would get faster answers and clearer steps. The Secretary must say within 30 days if an application is complete or what is missing. If complete and NEPA and other laws are satisfied the agency has 30 days to issue a permit. If the decision is deferred the agency must list steps and then decide no later than 10 days after applicants and agencies finish those actions.
- Land and environmental review would be preserved in part but limited. At each annual sale the Secretary must offer 75 percent of nominated parcels for lease and may withhold the remaining 25 percent only with a written statutory, environmental, or administrative justification.

Faster decisions on geothermal drilling permits
If enacted, the Interior Department would have 30 days after receiving a geothermal drilling permit application to say in writing if it is complete or what is missing. After it says the application is complete, the Department would have 30 days to issue the permit if environmental reviews are done, or defer and send the applicant the steps and agency actions needed with timelines that cannot exceed NEPA deadlines. If deferred, the Department would have to make a final decision within 10 days after those steps and actions are finished.
Yearly geothermal lease sales for developers
If enacted, the government would hold geothermal lease sales every year. For each sale, it would have to offer at least 75% of nominated parcels that are eligible under the resource management plan for the State. It would have to offer the rest unless it gives a written legal, environmental, or administrative reason. If a sale is canceled or delayed, a replacement sale would be held in the same year.
