Show full summary
  • Postal investigators would gain broader power to demand records and, in many cases, require custodians to testify about the production and authenticity of those records for investigations tied to defined offenses.
  • The authorization would explicitly cover offenses involving the mail under the Controlled Substances Act and hazardous materials rules, widening the range of mail-related crimes that can trigger subpoenas.
  • The bill would limit delegation of subpoena approval to senior officials only: the Postal Service General Counsel, a Deputy General Counsel, or the Chief Postal Inspector.

Stronger Postal Service subpoenas for mail crimes

If enacted, the Postal Service would get broader power to issue written subpoenas in mail-related crime investigations. This would include some drug cases that use the mail. Subpoenas could require records like books, papers, and other items. They could also require the records’ custodian to testify about production and authenticity. For investigations under section 3005(a), the custodian testimony would not be required. Only the Postal Service’s General Counsel, a Deputy General Counsel, or the Chief Postal Inspector could approve these subpoenas. If served, people or businesses would need to produce records or face legal steps.
