119-hr-1773119th Congress

Federal Firearms Licensee Protection Act of 2025

Sponsored By: Representative Rutherford, John H. [R-FL-5]

Introduced

Summary

Stronger federal penalties for thefts and attempted thefts of firearms from licensed sellers. This bill would expand criminal penalties tied to 18 U.S.C. §922(u) and explicitly cover attempts to commit those offenses.

Show full summary

Licensed importers, manufacturers, and dealers would see thefts from their business premises punished with a maximum of 20 years in prison and a fine.
Theft that occurs during a burglary would carry a mandatory minimum of 3 years in prison. Theft that occurs during a robbery would carry a mandatory minimum of 5 years in prison.
Attempts to violate §922(u) would be treated the same as completed violations. The bill defines burglary as unlawful entry into or remaining in a licensed firearms business with intent to commit a crime and ties robbery to the definition in 18 U.S.C. §1951(b).

Tougher penalties for gun business theft

If enacted, this bill would create new criminal penalties for people who knowingly violate 18 U.S.C. 922(u). It would also apply those penalties to attempts. It would allow fines and prison for up to 20 years. If the offense happens during a burglary of a licensed gun business, prison would be at least 3 years. If it happens during a robbery, prison would be at least 5 years. The bill would define burglary as unlawful entry into or remaining in the business premises of a licensed importer, manufacturer, or dealer with intent to commit a crime. It would also make an existing rule in 18 U.S.C. 924(m) apply to attempts involving licensed collectors.
