Summary
'Deemed granted' remedy
Show full summary
This bill would speed federal approvals for easements, rights-of-way, and leases for communications facility installations by creating a 'deemed granted' rule. It would replace the old “duly filed” standard with a clearer “complete” test and set timelines and receipt rules to trigger automatic grants when agencies miss deadlines.
- Applicants for communications facility permits would get a clear completeness test. The test requires taking the first procedural step under the agency’s rules and not receiving a written notice within 30 days that lists missing information.
- If an executive agency fails to grant or deny a complete application by the deadline, that application would be deemed granted on the day after the deadline.
- The new rules apply to applications under section 6409(b) that are received by an executive agency on or after the date of enactment, and are aimed at reducing administrative delay.

Automatic OK for late communications permits
This bill would change how federal permits for communications equipment on federal property are handled. An application would be complete when you take the first procedural step within your control under the agency’s process, and you do not get a written notice within 30 days after the agency receives it saying required information is missing. A complete application would be considered received on the day you submit all required items, or the day after that 30‑day period if the agency never asks for the missing items. If the agency does not approve or deny a complete application by the legal deadline, it would be deemed granted the next day. These rules would apply only to applications received on or after the date of enactment for federal easements, rights‑of‑way, or leases for communications facilities.
