Sponsored By: Representative Hinson, Ashley [R-IA-2]

Show full summary
  • DOJ and prosecutors: Creates a task force or program inside the DOJ Criminal Division to investigate and prosecute trade-related crimes and directs the Attorney General to add criminal trial attorneys and support staff. The structure must be established within 120 days after appropriations are available.
  • Businesses, importers, and traders: Expands investigations and prosecutions for duty evasion, smuggling, trade-based money laundering, and other violations tied to a long list of trade statutes. The definition explicitly excludes national security export control laws.
  • Congress and international partners: Requires an annual report to specified House and Senate committees with charged-case statistics, summaries of staff and operating expenses, and estimates of additional funding needs. It also directs DOJ to coordinate training and multi-jurisdictional assistance with Homeland Security and partner agencies.

Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

New Justice Department team for trade crimes

If enacted, the Justice Department would set up a team in its Criminal Division to investigate and prosecute trade‑related crimes. The team would start no later than 120 days after Congress provides money. DOJ would hire more trial attorneys and staff, train Homeland Security Investigations and Customs and Border Protection, and coordinate with other agencies. Work would focus on fraud, smuggling, and other trade harms, not national‑security export cases. Criminal Division cases would not block other DOJ civil or criminal actions; cases could move in parallel.

Yearly report on trade crime cases

If enacted, the Attorney General would send Congress a yearly report on trade‑crime enforcement, in consultation with Homeland Security. The first report would be due within one year of enactment. After that, reports would be due each year by February 1. Each report would show how many cases were publicly charged, how money was spent, and any extra funding needed.

Trade crimes defined, national security excluded

If enacted, the bill would define what counts as a trade‑related crime. It would cover schemes to dodge duties and tariffs, smuggling, and trade‑based money laundering tied to import and export laws like the Tariff Act of 1930 and the Trade Act of 1974. It would not cover national‑security export and sanctions laws, including the Arms Export Control Act, the International Emergency Economic Powers Act, the Export Control Reform Act, and the Trading with the Enemy Act.
