Department of Defense PFAS Discharge Prevention Act

Sponsored By: Representative McClellan, Jennifer L. [D-VA-4]

In Committee

Summary

This bill would require the Department of Defense to push for mandatory PFAS stormwater monitoring at its facilities and set a funding floor for testing. It targets two goals: routine testing of PFAS in stormwater and adding controls to reduce PFAS discharges from DoD sites.

Show full summary
  • DoD facilities: Would have to seek permit or stormwater plan changes that require monitoring of perfluoroalkyl and polyfluoroalkyl substances at least quarterly and use best management practices or control technologies to cut PFAS runoff.
  • State permit agencies and the Environmental Protection Agency: Would be asked to approve revisions to Clean Water Act section 402(p) stormwater permits or plans to add PFAS monitoring and controls at DoD sites.
  • PFAS remediation funding: At least 1% of funds the bill makes available for DoD PFAS remediation each year would be obligated or spent on testing for PFAS in stormwater runoff at DoD facilities.

More PFAS testing at military bases

If enacted, the Defense Department would need to ask states or the EPA within one year to update stormwater permits for DoD facilities. The requested changes would require PFAS testing of discharges at least every quarter. DoD would also need to use best practices or control technology to cut PFAS runoff, consistent with the Clean Water Act. Each fiscal year, at least 1% of PFAS cleanup funds would be used for stormwater PFAS testing at DoD sites. Nearby communities could see more testing and steps to reduce pollution from base runoff.
