No Fuel Credits for Batteries Act of 2025

Sponsored By: Representative Miller-Meeks, Mariannette [R-IA-1]

Introduced

Summary

Bars electricity-based renewable fuel credits from counting toward Renewable Fuel Program obligations. This bill would stop the Environmental Protection Agency from authorizing electricity-derived renewable fuel credits for meeting the Clean Air Act's transportation fuel volume requirements and would prohibit the use or transfer of any such credits generated before enactment.

Show full summary
  • Companies with renewable fuel volume obligations could no longer use electricity-based credits to meet those targets. This changes what eligible credits obligated parties can rely on.
  • Electricity producers and battery operators that sought or held credits tied to electricity from renewable fuel would lose the ability to use or transfer those credits, including ones created before enactment.
  • The Environmental Protection Agency must align program credit rules with the Clean Air Act definitions of "renewable fuel" and "transportation fuel," removing electricity-based credit pathways.

Ban electricity credits in fuel program

The bill would stop EPA from letting electricity made from renewable fuel earn credits toward federal renewable fuel targets for transportation fuel. EPA would also have to block the use or trade of any such credits created before this bill becomes law. This would take effect at enactment and use the Clean Air Act definitions of renewable fuel and transportation fuel. Fuel makers and credit holders could face higher compliance costs, which could be passed on in fuel prices.
