Sponsored By: Representative Barrett, Tom [R-MI-7]
Introduced
Summary
Keep Martin Luther King, Jr. Day separate from Presidential Inauguration Day. This bill would amend Section 6103 of Title 5 by adding a rule that if Inauguration Day would be observed on the legal public holiday for the Birthday of Martin Luther King, Jr., then the date for the Birthday of Martin Luther King, Jr. would be the Tuesday following the third Monday in January.

Workers' MLK Day shifts if Inauguration overlaps
If enacted, this bill would move Martin Luther King Jr. Day in any year it overlaps with Inauguration Day. In those years, the MLK Day observance would be the Tuesday after the third Monday in January. Federal employees and agencies would observe the holiday on Tuesday. Employers that follow the federal holiday calendar could shift closures and holiday pay to that Tuesday. The text here does not set an effective date.
