SAVE Act

Sponsored By: Representative Roy, Chip [R-TX-21]

Passed House

Summary

This bill would require documentary proof of U.S. citizenship for federal voter registration and expand verification, data sharing, and removal procedures to identify noncitizens from federal voter rolls.

Show full summary
  • Voters and applicants: People registering for Federal elections would need to provide listed documents such as REAL ID–compliant ID, birth or naturalization certificates, or a Qualified American Indian Card. The national mail registration form would add a field to record the document type.
  • States and election officials: States would have to verify citizenship before registering someone to vote in Federal elections and rely on Department of Homeland Security (DHS) tools including the Systematic Alien Verification for Entitlements (SAVE) program and the Social Security Administration (SSA) verification service. States must implement programs to identify noncitizens within 30 days and share certain information within 24 hours.
  • People without documents and enforcement: The Election Assistance Commission (EAC) must create a uniform affidavit and processes for applicants who lack proof, and provisional ballots can still be counted if citizenship is later verified. The bill authorizes removing noncitizens from Federal voter lists, expands private suits under the law, and increases criminal penalties for assisting noncitizen registration or voting.

Bill Overview

Analyzed Economic Effects

4 provisions identified: 1 benefits, 1 costs, 2 mixed.

New document checks at DMVs and agencies

If enacted, State motor vehicle offices would have to verify that driver’s license applicants are U.S. citizens. Agencies that help people register would have to ask, “Are you a U.S. citizen?” If you answer yes, you would have to show proof of citizenship before the agency gives you a voter registration form. These steps would add document checks at DMVs and other registration sites.

Path if you lack citizenship documents

If enacted, you could sign a sworn statement and give other evidence if you do not have citizenship papers. A State or local official would review it, and a standard affidavit from the Election Assistance Commission would document any approval. Each State would have to set up a verification program within 30 days and could check federal and State databases, including DHS SAVE and SSA. Federal agencies would need to share relevant data with State election officials within 24 hours of a request. States would also have to provide reasonable ways for people with disabilities to present proof for mail registrations.

Show citizenship to register for federal elections

If enacted, you would need to show proof of U.S. citizenship to register for a federal election. Mail applicants would have to bring proof in person by the State’s registration deadline, or at the polling place by election day where same‑day registration is allowed. Accepted proof would include a U.S. passport, certain REAL ID documents that show citizenship, military ID with a record of U.S. birth, or a government photo ID plus papers like a certified birth certificate, a Consular Report of Birth Abroad, a Naturalization or Citizenship Certificate, or an American Indian Card marked “KIC.” If you vote provisionally, your ballot would count if your citizenship is later verified.

Faster data and guidance for voter rolls

If enacted, Homeland Security would promptly tell your State’s chief election official when you become a naturalized U.S. citizen. The Election Assistance Commission would send States guidance within 10 days on how to apply the new rules. The Paperwork Reduction Act review would not apply to changing voter registration materials, so forms and instructions could be updated faster.
