Veterans Infertility Treatment Act of 2025

Sponsored By: Representative Brownley, Julia [D-CA-26]

In Committee

Summary

Expands VA health coverage to include infertility treatments and fertility preservation for veterans and their partners. This bill would authorize the Department of Veterans Affairs to furnish assisted reproductive technology and standard fertility preservation services under defined rules and limits.

Show full summary
  • Veterans and partners: Eligible veterans enrolled in VA care who have infertility or are at risk of infertility and partners chosen by those veterans could receive infertility treatments and storage of gametes and embryos.
  • IVF limits and consent: The VA could provide up to 3 completed in vitro fertilization cycles that result in live birth or up to 10 attempted IVF cycles. Treatment may use donated gametes or embryos and requires consent from the covered individual, the veteran if the patient is a partner, and any third party donor.
  • Implementation and interim access: The Secretary must issue regulations within one year and, during the 180-day interim period, ensure partners can receive counseling and treatment regardless of marriage and allow use of donated gametes or embryos to preserve continuity of care.
  • Legal and travel rules: State law will determine custody and disposition of gametes and embryos and the VA would deem a partner receiving treatment eligible for veteran beneficiary travel payments.

Infertility care for veterans, partners

If enacted, VA would be allowed to provide infertility treatments and fertility preservation to enrolled veterans who have or are at risk of infertility, and to partners the veteran selects. VA would be able to furnish assisted reproductive technology, including IVF using donated eggs, sperm, or embryos. For IVF, VA would pay for up to 3 completed cycles that result in live birth or up to 10 attempted cycles, whichever comes first. The Secretary would need consent from the covered individual, the veteran when the patient is a partner, and any third‑party donor. The Secretary would issue regulations within one year, and interim rules starting 180 days after enactment would let partners get care regardless of marital status and allow donated gametes or embryos. State law where eggs, sperm, or embryos are located would decide ownership and disposition, and VA would not be required to provide maternity care beyond existing law. Partners getting these services would be treated like veterans for VA travel payments tied to the care.
