Saving NIST’s Workforce Act

Sponsored By: Representative Lofgren, Zoe [D-CA-18]

Introduced

Summary

Places a temporary moratorium on involuntary personnel cuts at the National Institute of Standards and Technology until Congress enacts full-year FY2026 appropriations. The Saving NIST's Workforce Act would bar NIST from starting or carrying out reductions in force or involuntary separations of competitive service employees, excepted service employees, career employees in the excepted service, and career Senior Executive Service appointees except when removed for misconduct, delinquency, or inefficiency, and it adopts the Title 5 definitions for those personnel terms.

Temporary pause on NIST layoffs

If enacted, NIST would not be allowed to start layoffs or force out staff until full‑year FY2026 NIST funding is signed into law. It would cover competitive service, excepted service (including career), and career Senior Executive Service appointees. NIST could still remove employees for cause, such as misconduct, delinquency, or inefficiency. The pause would start at enactment and end when full‑year FY2026 NIST appropriations become law.
