  • Workers: Employees in units would be represented only if a majority votes in a secret-ballot election run by the Board. This changes how workplace support is certified for post-enactment organizing.
  • Employers: An employer would be barred from recognizing or bargaining with a union unless the Board has conducted a secret-ballot election showing majority support. That applies only to recognition or bargaining that begins after enactment.
  • Labor organizations: Unions would need Board-run secret-ballot certification or reconfirmation to become or remain a unit’s representative for relationships formed after enactment.
  • National Labor Relations Board: The Board is tasked with conducting and enforcing these elections and must review and revise its pre-existing regulations within 6 months after enactment.

Secret-ballot votes to choose workplace unions

This bill would require unions to be chosen by a secret-ballot vote run by the National Labor Relations Board. Employers would only be able to recognize or bargain with a union that won a majority in that Board-run vote. The Board would also run secret-ballot votes to remove a union. These rules would apply only to recognition or bargaining after enactment. Existing union relationships would not change. The Board would have 6 months after enactment to update its regulations to carry this out.
