Show full summary
  • Specified tax‑exempt organizations would owe a penalty equal to twice any "disqualified political committee contribution" if they received any contribution from a foreign national during an eight‑year testing window.
  • An organization that makes more than two disqualified contributions would lose its tax‑exempt status for any taxable year ending on or after the third such contribution.
  • The rule applies only to organizations with at least $200,000 in annual gross receipts or $500,000 in assets, so smaller nonprofits below both limits are not covered.
  • The measure adopts Federal Election Campaign Act definitions for "foreign national" and "political committee" and applies to contributions made on or after January 1, 2026.

Penalties on foreign-funded nonprofit political giving

This bill would fine certain 501(c) nonprofits that take foreign money and then give to political committees. It would cover groups with at least $200,000 in yearly receipts or $500,000 in assets. If the group received any gift from a foreign national in the 8 years before its political gift, that gift would be disqualified. The penalty would be twice the contribution amount. For example, a $10,000 gift would trigger a $20,000 penalty. If a group makes more than two disqualified gifts, it would lose tax‑exempt status for any tax year ending on or after the date of the third gift. For the first three violations, the group would still be treated as tax‑exempt when applying these penalties. The 8‑year lookback would not count time before the bill is enacted. These rules would apply to contributions made on or after January 1, 2026.
