SHARE Act of 2026

Sponsored By: Representative Mann, Tracey [R-KS-1]

In Committee

Summary

Allow the FBI to share criminal history records with state licensing boards for interstate compact background checks. This bill would let State licensing authorities receive criminal history record information through agreements with State law enforcement agencies or State identification bureaus, and it would set tight limits on how that information is used or shared.

Show full summary
  • Applicants: Workers seeking multistate licenses would face FBI-based criminal history background checks that can affect eligibility to obtain or use a license in compact member States.
  • State licensing authorities: Boards could receive criminal history record information only via agreed arrangements and must use it solely for the background check. They may not share the records or details with other States, commissions, or the public.
  • Compact commissions: Commissions could be told only that a background check was completed and whether it was satisfactory. They would not receive the underlying criminal history details.

FBI criminal checks for license applicants

If enacted, the bill would let the FBI give criminal history records to State licensing authorities. The FBI would share records through agreements with State law enforcement or State identification bureaus. CHRI would include arrests and case outcomes and would exclude fingerprint ID that shows no criminal justice involvement. State licensing authorities in compact States would use CHRI only for the required background check. They would not be allowed to share CHRI with the compact Commission, other States, or the public. They would be allowed to notify the Commission only that the check finished and whether it was satisfactory.
