Sponsored By: Representative Miller, Mary E. [R-IL-15]
Introduced
Summary
Birth-based sex determination for locker room access would define "same sex" only by reproductive biology and genetics at birth and bar anyone from using a school locker room while it is in active use by people of a different birth sex. The rule would apply to locker rooms used in any education program or activity covered by Title IX.
Show full summary
- Female students: Would be limited to locker rooms used only by those identified as female at birth when the room is in active use. This changes who schools must allow into girls' locker rooms during use.
- Transgender students: Would be barred from using a locker room in active use by the opposite birth sex under the bill's birth-based standard. Daily access for students whose gender identity differs from their sex at birth would be affected.
- Schools and enforcement: Would have to apply the birth-based standard in Title IX compliance. The bill would rely on existing Title IX enforcement, create no new funding, and take effect 30 days after enactment with no phase-in or exemptions.

School locker room access by birth sex
If enacted, schools and programs covered by Title IX would have to limit locker rooms in active use to people of the same sex as determined by reproductive biology and genetics at birth. Using a different-sex locker room while it is in use would be a Title IX violation. This standard would apply to locker rooms used for any education program or activity. It would rely on existing Title IX enforcement and add no new funding or exemptions. The rules would start 30 days after enactment.
