Sponsored By: Representative Harrigan, Pat [R-NC-10]
Introduced
Summary
Blocks long-term retail agreements on military bases with companies controlled by certain foreign nations. This bill would create a two-track national-security screening system that bans new or renewed long-term concessions unless narrowly waived, requires review by the Committee on Foreign Investment in the United States, and allows termination when ownership or disclosures are false or missing.

- Service members and families would see stricter limits on who can run base stores, with waivers allowed only if goods or services are vital for welfare and morale and no reasonable alternatives exist, plus required risk-mitigation steps and a 30-day congressional report when a waiver is used.
- The Department of Defense would have to assess existing long-term concessions within 180 days and terminate agreements found to be controlled by a covered nation within 12 months after a determination.
- Covered retailers and foreign owners would face a notice requirement to CFIUS within 30 days of enactment, a ban on operating until CFIUS approves, a 180-day CFIUS decision window, annual ownership disclosures, and immediate termination for noncompliance.

2 provisions identified: 0 benefits, 1 costs, 1 mixed.
Ban on new base store deals with foreign-controlled retailers
If enacted, the Defense Department would be barred from signing or renewing long‑term store deals on U.S. bases with retailers controlled by a covered foreign nation. The ban would apply to agreements entered on or after the date of enactment. The bill would define control to include when a covered nation owns 20% or more, the retailer is organized under that nation’s laws, or there is direct or indirect control. It would also define what counts as a long‑term concessions agreement, including contracts, subcontracts, leases, or licenses for a physical store on a U.S. military installation.
Security checks for existing base retailers
If enacted, covered retailers already performing a long‑term concessions agreement on or before enactment would need to notify the foreign‑investment review committee within 30 days and could not operate unless approved. The committee would investigate ties to covered nations and issue a decision within 180 days after its investigation ends; approved retailers would need to report ownership changes each year or face immediate termination. The Defense Secretary would review every existing long‑term agreement within 180 days. If a retailer is found controlled by a covered nation or lied about ownership, the Secretary would end the deal; the bill lists both 30‑day and one‑year termination clocks in different sections. The Secretary could waive termination only if the goods or services are vital, no reasonable alternatives exist, and risks are mitigated, and would have to brief Congress within 30 days after using a waiver.
