Staff Sergeant John D. Martek Purple Heart Restoration Act

Sponsored By: Representative Kennedy, Timothy M. [D-NY-26]

Introduced

Summary

Authorizes the Purple Heart for veterans whose traumatic brain injury was caused by an enemy act. The bill would let veterans who experienced a TBI attributable to an enemy act on or after December 7, 1941, receive the Purple Heart if the Department of Veterans Affairs finds a service‑connected disability from that TBI or if military records document the injury. Each service secretary would set up an application process and award the medal to qualifying applicants regardless of when the injury occurred. The bill uses the Title 38 meanings for “veteran” and “service‑connected.”

Purple Heart for brain-injured veterans

If enacted, this bill would let some veterans with a traumatic brain injury receive the Purple Heart. The injury must have happened while serving, from enemy action, on or after December 7, 1941. A veteran would qualify if VA finds a service-connected disability from that TBI, or if a military record shows the TBI. Each military department would set an application process and award the medal to eligible applicants, even if the injury was long ago. For this medal, these TBIs would be treated like wounds received in action.
