Bill Overview

Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Define special districts and aid

If enacted, the bill would define what a "special district" is for federal programs. It would say a special district is a state-created political subdivision with set boundaries and its own budget control. The bill would say "State" includes DC, territories, possessions, and federally recognized Indian Tribes. It would list federal help such as grants, loans, property, cooperative agreements, interest subsidies, insurance, food commodities, and direct appropriations. Payments that are reimbursements for services to an individual would not count as Federal financial assistance under OMB guidance.

OMB guidance for special districts

If enacted, the bill would require the OMB Director to issue guidance within 180 days after enactment clarifying that special districts can be treated as units of local government eligible for Federal financial assistance. The head of each federal agency would have one year after that guidance is issued to change policies, practices, or procedures to follow it. Not later than two years after enactment, OMB would send a report to the House Oversight and Senate Homeland Security committees evaluating agency implementation and conformity to the guidance.
