GOSAFE Act
Sponsored By: Representative McBath, Lucy [D-GA-6]
Introduced
Summary
This bill would target the possession and trade of gas-operated semi-automatic firearms and large-capacity ammunition feeding devices by creating a federal ban and a formal listing and review process. It adds specific technical definitions for gas-operated semi-automatic firearms and for large-capacity ammunition feeding devices (more than 10 rounds, excluding most .22 rimfire-only devices).
Show full summary
- Gun owners and transfers: It would bar import, sale, manufacture, transfer, receipt, and possession of firearms that appear on a government list of prohibited gas-operated semi-automatic weapons, and would cover modifications that make a firearm operate as such. The bill includes limited transfer and possession exceptions for immediate family members under defined conditions.
- Manufacturers, dealers, and the ATF: It would require licensed importers and manufacturers to mark covered firearms and create a new Section 935 to publish a prohibited list within 180 days. The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) would review design approval applications within 240 days, charge fees, and deposit revenue into a new Firearm Safety Trust Fund funded by ATF-collected taxes and fees.
- Enforcement, penalties, and community programs: It would authorize Byrne Grants to pay for buy-back programs to compensate surrendered firearms and magazines. Violations would carry new penalties of up to $5,000 and up to 12 months in prison, and possession tied to a federal crime punishable by more than one year could bring up to $250,000 in fines and 2 to 10 years in prison.

Bill Overview
Analyzed Economic Effects
4 provisions identified: 1 benefits, 1 costs, 2 mixed.
Ban on certain gas-operated guns
This bill would make it unlawful to import, sell, make, transfer, receive, or possess gas-operated semi-automatic firearms and many large-capacity feeding devices as described in the law. It would exempt firearms lawfully made and transferred before enactment and limited transfers to immediate family members done through a licensed dealer, plus certain government and Atomic Energy Act security uses. Violations would carry fines up to $5,000 and up to 12 months in jail. If someone possessing a prohibited gun commits or attempts another federal felony, penalties rise to up to $250,000 and 2 to 10 years in prison.
New approval process for makers
This bill would require any semi-automatic firearm design made on or after enactment to get written approval from the Attorney General before it may be manufactured or sold across state lines. Makers would file detailed applications, supply physical samples, and pay fees set by the Attorney General; approvals must be decided within 240 days, and makers can appeal denials to the agency and then to court. The bill would create a Firearm Safety Trust Fund to hold ATF tax receipts and these fees to run the program. It would also require licensed importers and manufacturers to mark firearms and certain feeding devices made under exemptions before transfer and forbid altering serial numbers on those devices.
ATF prohibited list and rules
This bill would require the ATF to publish and update a list of gas-operated semi-automatic firearms covered by the prohibition within 180 days of enactment. Licensed dealers would have to record that buyers saw the published list before selling any firearm not on the list. The bill also adds legal definitions for key terms like "semi-automatic firearm," "gas-operated," "cycle the action," "large capacity ammunition feeding device," and "immediate family member," effective on enactment.
Buy-back payments allowed with Byrne funds
This bill would allow Byrne Grant funds to be used to pay people who turn in covered gas-operated firearms or large-capacity feeding devices in buy-back programs. The law would not set how much jurisdictions must pay; local or state agencies would decide whether to run such programs and at what price.
