Show full summary
  • Workers who were serving in a probationary or trial status after a promotion and who were removed from a covered career position between January 20, 2025 and the date of enactment could choose reinstatement to the same or an equivalent position with backpay under section 5596 of Title 5.
  • Department of Veterans Affairs employees promoted into VA positions would be treated as covered by the due process protections in section 714 of Title 38, aligning their post-promotion appeals with that VA standard.
  • The bill excludes political positions from these rules and defines those positions to include Executive Schedule jobs, noncareer appointees, and Schedule C roles.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Federal workers get reinstatement and due process

If enacted, this would give promoted federal workers in a probationary or trial period standard due‑process and appeal rights. That would apply after promotions into competitive service, career excepted service, and career Senior Executive Service roles. For VA employees in a trial period after a promotion, it would apply VA’s section 714 rules. It would also let workers removed between January 20, 2025 and the date of enactment choose reinstatement to the same or an equivalent job, with back pay under 5 U.S.C. 5596. These changes would start on enactment.

Political appointees excluded from protections

If enacted, the new due‑process and reinstatement rights would not cover political positions. Political positions would include Executive Schedule jobs, noncareer SES appointees, and Schedule C roles. This exclusion would apply to both the protections and the reinstatement with back pay, starting on enactment.
