Preventing Violence Against Women by Illegal Aliens Act

Sponsored By: Representative Mace, Nancy [R-SC-1]

Passed House

Summary

Expands inadmissibility and deportability for sex and violent offenses. This bill would make convictions or admissions for sex crimes, domestic violence, stalking, child abuse, and certain protection‑order violations explicit grounds to deny entry or remove noncitizens from the United States.

Show full summary
  • Noncitizens convicted of, or who admit to committing, sex offenses as defined by the Adam Walsh Child Protection and Safety Act would be inadmissible and deportable. This includes conspiracies tied to those offenses.
  • People convicted of domestic violence, stalking, child abuse, child neglect, or child abandonment would also be barred from admission and made deportable. Violating parts of a protection order that involve credible threats, repeated harassment, or bodily injury is covered too.
  • The bill aligns immigration rules with existing federal statutes. It uses the Adam Walsh Act definitions and treats domestic violence as deportable under the Violent Crime Control and Law Enforcement Act regardless of whether a jurisdiction receives VCCLEA grant funding.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 2 costs, 0 mixed.

Noncitizens deportable for sex and domestic violence

This bill would add and expand deportation grounds. Noncitizens convicted of a sex offense, or conspiracy to commit one, would be deportable. Crimes that meet the federal definition of domestic violence would also make a person deportable, even if the local area does not get grants under that 1994 law. These changes would take effect upon enactment.

Tougher entry bars for noncitizens with sex or abuse crimes

This bill would add new entry bars for some noncitizens. A conviction for a sex offense, or admitting the acts that make up that offense, would block a visa, entry, or a green card. The same would apply to domestic violence, stalking, child abuse or neglect, or violating a protection order that guards against threats, harassment, or injury. Conspiracies to commit a sex offense would also count. These rules would apply at visa interviews, at the border, and during status adjustment, and would take effect upon enactment.
