Show full summary
- Oil and gas operators — Existing permit holders and similarly situated prospective permittees would remain subject to the terms, conditions, and requirements of an expired offshore permit until a new permit is issued.
- Federal agencies and regulators — The Secretaries would coordinate with other federal agencies and may form joint agency working groups to streamline continuity. Any new working group must be reported to Congress and the President within 15 days with officials' names, scope, objectives, and an estimated duration in days.
- Water and species compliance — The EPA Administrator would apply the same terms from expired multi-permit water discharge permits to covered permittees until replacements are issued. Compliance with the National Marine Fisheries Service Biological Opinion issued March 13, 2020 and amended April 24, 2021 would be treated as satisfying Endangered Species Act and Marine Mammal Protection Act requirements until a new biological opinion is approved.

Offshore oil permits stay in force
If enacted, when a federal permit for offshore oil and gas expires, the Secretary would keep its terms in place for covered companies and similar new applicants until a new permit is issued, within their authority. The Secretary would coordinate with other agencies and could set up joint working groups. Any new working group would have to be reported to Congress and the President within 15 days, with member names and titles, goals, and an expected duration in days. For BOEM leasing, following the March 13, 2020 biological opinion (amended April 24, 2021) would count as meeting Endangered Species Act and Marine Mammal Protection Act duties until a new biological opinion is approved.
Businesses keep wastewater terms during renewals
If enacted, EPA would keep the same wastewater permit terms while a new multi-facility permit is being issued. This would apply when the new permit is reasonably similar to the expired one and covers similar operations and discharges. Both current and prospective permittees would follow the old terms until the new permit is issued. This would give regulated businesses more certainty during renewals.
