Biodiesel Tax Credit Extension Act of 2025

Sponsored By: Representative Carey, Mike [R-OH-15]

Introduced

Summary

This bill would extend federal biodiesel and renewable diesel tax incentives and set rules to prevent "double dipping" with the new Clean Fuel Production Credit. It coordinates existing biodiesel, mixture, and alcohol fuel credits with the Clean Fuel Production Credit so taxpayers cannot claim both for the same fuel.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Biofuel credits extended to 2026-2027

If enacted, biodiesel and renewable diesel tax credits would run through 2026 instead of ending in 2024. The biodiesel mixture credit and related credits for fuel not used for taxable purposes would also run through 2026. Rules for second-generation biofuel credits would extend to January 1, 2027. These changes would apply to fuel sold or used after December 31, 2024, and to second-generation biofuel made after that date.

No double-dipping on biofuel credits

If enacted, producers who claim the clean fuel production credit for a fuel could not also claim biodiesel, renewable diesel, biodiesel mixture, or second-generation biofuel credits for that same fuel. In those cases, the other credit amounts would be zero. This would apply to fuel sold or used after December 31, 2024, and to second-generation biofuel made after that date.
