Preventing Environmental Hazards Act of 2025
Sponsored By: Representative Murphy, Gregory F. [R-NC-3]
Introduced
Summary
Would add a new "erosion coverage" to the National Flood Insurance Program to pay for demolition or relocation when shoreline erosion makes a structure unsafe. The coverage would apply to structures condemned as imminently collapsing, sitting partially over water, on bliffs, or below Mean Higher High Water. It would pay 40% of a structure's value at claim and the remaining 60% after demolition within 6 months, or up to actual demolition cost. Relocation payments would cover up to 40% of value and not exceed actual relocation costs. Payments are capped by the policy limit or $250,000 and would not cover contents. Structures must have qualifying prior flood insurance to be eligible and, after a final determination, would be barred from further NFIP coverage or most disaster assistance for that structure.

Help to Move or Demolish Shore Homes
This bill would let NFIP pay to demolish or relocate shorefront structures that a State or local authority certifies as imminently unsafe from shoreline erosion or certain siting conditions (for example, over water, on a shoreline bluff, or below mean higher high water). For demolition, NFIP would pay 40% of the structure's value after final certification. If you demolish (including removal of any septic system) within six months and before collapse, NFIP would pay the remaining 60% or the actual demolition cost, whichever is less. If you choose relocation, NFIP would pay up to 40% of the structure's value before collapse, but total relocation payments could not exceed the actual relocation cost. If the structure collapses or you fail to act and the Administrator finds you did not take reasonable action, payment would be limited to the initial 40%. The structure value for payments would be the lowest of three measures set by the bill. Any payment would be limited to the lesser of your policy coverage amount or $250,000, and contents (household belongings) would not be covered. To qualify, the property must have an NFIP policy in effect on or entered into after enactment, must have been subject to an NFIP contract on the date of certification, and must meet the bill's prior-coverage requirement (either 12 months of NFIP coverage on or before enactment or four continuous years of coverage before the certification). Once a structure receives a final determination and assistance, it would be barred from getting further NFIP flood insurance or most Disaster Relief Act aid for that structure or for a different structure on the remaining parcel, except emergency aid to save lives and protect health and safety. The Administrator would issue regulations and the amendment would take effect on the date of enactment.
