LOCOMOTIVES Act

Sponsored By: Representative Moolenaar, John R. [R-MI-2]

In Committee

Summary

Clarifies and expands federal authority over emissions from locomotives and certain nonroad engines. The bill revises Section 209(e)(1) of the Clean Air Act to redefine which nonroad engines and vehicles the federal government can regulate and to prohibit State standards relating to emissions from existing locomotives and engines used in locomotives. It also adds a new definition that explicitly covers locomotives engaged in commerce as defined by federal railroad law.

Show full summary
  • States: Limits state power by prohibiting state emissions standards for existing locomotives and engines used in locomotives, shifting those controls into the federal framework.
  • Rail carriers and common carriers: Locomotives that are "engaged in commerce" are explicitly placed under federal regulation, a term the bill ties to common carrier rail service for compensation under 49 U.S.C. 10102.
  • Owners and makers of small nonroad equipment: Engines used in construction or farm equipment that are smaller than 175 horsepower are specified as subject to regulation under the Clean Air Act, clarifying federal oversight of those machines.

Stops State Rules on Locomotive Emissions

If enacted, this bill would amend the Clean Air Act to bar States from adopting standards that control emissions from existing locomotives and engines used in locomotives. It would change the listed categories of nonroad engines so engines in locomotives are explicitly covered and add a new definition for locomotives "engaged in commerce," including common carrier railroads under 49 U.S.C. 10102. It would also tighten the construction and farm engine item to cover equipment under 175 horsepower that is subject to the Clean Air Act. These changes would shift regulatory authority to the federal definition the bill sets and would take effect upon enactment.
