Reproductive Data Privacy and Protection Act
Sponsored By: Representative Lieu, Ted [D-CA-36]
Introduced
Summary
Protects reproductive and sexual health communications from government use in investigations and prosecutions. It would require sworn affirmations in wiretap and compelled‑disclosure applications that the government will not use intercepted communications or compelled records about reproductive or sexual health, including abortion, in vitro fertilization, contraception, pregnancy status, and related care, to investigate or prosecute people who inquire about, seek, obtain, provide, or facilitate that care.

- Families and patients: People seeking reproductive care would be shielded from having wiretaps or compelled records about their reproductive health used to open investigations or prosecutions.
- Health care providers and facilitators: Clinicians, clinics, and others who help arrange or provide reproductive services would be protected from having their communications used to trigger legal action.
- Government and law enforcement: Applications for interceptions and compelled disclosures would need explicit sworn statements that the obtained contents will not be used to target reproductive or sexual health activity.

Privacy rules for reproductive health data
If enacted, government agencies would need a sworn statement to get or intercept communications or records. They would have to promise not to use any contents, including reproductive or sexual health info, to investigate or prosecute people who seek, provide, or help with care. This would apply to subpoenas, court orders, warrants, and wiretap applications and orders. The bill would define covered reproductive or sexual health information, including abortion, IVF, birth control, medication abortion, pregnancy, menstruation, ovulation, ability to conceive, sexual activity, and related services. These rules would take effect upon enactment and could lower the risk that private health messages are used against patients, providers, or helpers.
