American Energy Act

Sponsored By: Representative Boebert, Lauren [R-CO-4]

Introduced

Summary

Limits judicial disruption of federal oil and gas leasing to keep lease processing and drilling authorizations moving. This bill would speed how permits to drill are handled, set a fixed four-year permit term, and narrow when courts can stop lease awards under federal environmental review laws while relying on existing leasing statutes.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Fewer court delays on oil and gas leases

If enacted, courts could only stop or undo lease work when there is imminent and substantial environmental harm and no other fix. In NEPA cases, courts would not be able to block awarding leases after bids are opened or a high bidder is named. Interior would need to keep processing drilling permits on valid leases during lawsuits, unless a federal court already vacated the lease. This would not give courts new power to cancel leases. These rules would start on enactment.

Four-year term for new drilling permits

Permits to drill issued after enactment would last for one four-year term from approval. If the related lease ends sooner, the permit would end then. This would not change lease end dates. Operators would get a clear, fixed permit window.
