Chip Security Act

Sponsored By: Representative Huizenga, Bill [R-MI-4]

In Committee

Summary

Would require covered integrated circuit products to include chip security mechanisms that verify location before export, reexport, or in-country transfer. It sets an initial 180-day window for location-verification requirements and directs Commerce to study and possibly add tamper-detection or other controls later.

Show full summary
  • Manufacturers and exporters: Would have to outfit covered IC products with location-verifying chip security mechanisms before export, reexport, or in-country transfer, with a 180-day compliance window.
  • Licensed exporters and users: Would need to report promptly to the Commerce Under Secretary if credible information shows a product is in the wrong location, diverted, or tampered with. The Secretary could verify ownership and location and require licensees to keep records.
  • Commerce Department and Congress: Would conduct a one-year assessment of additional security mechanisms and report findings to Congress. If warranted, the Secretary could require secondary mechanisms within two years of that assessment and carry out annual reviews to consider new options and export-control changes.

2 provisions identified: 0 benefits, 0 costs, 2 mixed.

New chip location and reporting rules

If enacted, the bill would require covered chips and products to include location‑verification security before any export, reexport, or in‑country transfer to a foreign country. The Secretary would have authority to verify a product's ownership and location and to keep records with location and end‑user information. Anyone holding an export license or authorization would have to promptly report credible information that a product is in the wrong place, was diverted, or was tampered with. Companies and license holders would have 180 days after enactment to meet the location verification and reporting rules.

Study and possible new chip security rules

If enacted, the bill would require the Secretary of Commerce to assess additional chip security mechanisms and report to Congress within one year. The study must examine feasibility, costs, reliability, tamper risks, and estimated scale costs. If the Secretary selects additional mechanisms, covered products would have to include them no later than two years after the assessment is finished. Beginning two years after enactment, the Secretary would also review new mechanisms yearly for three years and report on whether export rules should be eased for compliant products.
