Show full summary
  • Families and detainees would see more detailed public data. Reports must include names and nationalities of those detained or removed, records of assaults, sexual assaults, deaths, medical transfers, and complaints about access to counsel and facility conditions.
  • Congress and independent auditors would get tight reporting timelines and follow-up recommendations. DHS must send an initial information report within 30 days, a joint DHS-HHS report within 60 days, and the Comptroller General would issue recommendations within 90 days of receiving the material.
  • DHS and HHS would face new notification and transparency rules for unusual detention sites. Agencies would need to give at least 60 days notice before using non-traditional locations such as Department of Defense property, Indian lands, or lands outside the continental U.S., and provide standards of care, timelines, budgets, and compliance information.

More detention transparency for immigrants and families

If enacted, the bill would require DHS to report to Congress within 30 days on all CBP and ICE encounters and removals since January 21, 2025. The 30-day report would list detained and removed people by name, nationality, alien number when available, the legal or other authority for each detention or removal, and the destination country. DHS and HHS would jointly report to Congress and the Comptroller General within 60 days about incidents in CBP, ICE, and ORR custody, including assaults needing medical care, sexual assault reports and findings, local law enforcement calls, overnight medical transfers, deaths, and complaints and any remedial actions, including access to lawyers. The Comptroller General would then have 90 days to give recommendations on those incidents and complaints, including effects of oversight office closures, visitation and access compliance, more inspector reviews, and better detainee-location tracking (including final repatriation locations in the ICE locator). The bill would also require DHS or HHS to notify Congress at least 60 days before using a non-traditional detention site and to provide the specific location, justification, number of beds, care standards and medical access, timeline, budget, and any agreements. Non-traditional sites would include Department of Defense property, buildings on Indian lands as defined in regulation, and lands outside the continental United States.
