Striking and Locked Out Workers Healthcare Protection Act
Sponsored By: Representative Deluzio, Christopher R. [D-PA-17]
Introduced
Summary
Protects employer-sponsored group health coverage during lockouts and lawful strikes. This bill would make it an unfair labor practice for an employer to terminate or alter a group health plan during employer lock-outs or when employees engage in a lawful strike.
Show full summary
- Workers and households: Striking or locked-out employees would keep their group health plan coverage during the dispute. The bill ties “group health plan” to ERISA’s definition.
- Employers (lock-outs): Employers who cut coverage during a lock-out could face civil penalties up to $75,000 per violation, rising to $150,000 for repeat violations that cause discharge or serious economic harm.
- Employers and officers (strikes and liability): Coverage cuts during lawful strikes carry penalties up to $50,000 per violation, rising to $100,000 for repeat serious cases. Company directors or officers can be held personally liable if they directed or failed to prevent violations, and the National Labor Relations Board must weigh gravity, employer size, history, and public interest when setting penalties.

Workers keep health coverage in strikes and lockouts
If enacted, employers would be barred from ending or changing your group health coverage during a lawful strike. They also would be barred during an employer lockout or suspension used to pressure bargaining before a strike. These rules would apply to plans that meet ERISA's group health plan definition. Plan administrators would need to keep your coverage in place for those periods.
Fines for cutting coverage in disputes
If enacted, employers who cut or change coverage during a lawful strike could face up to $50,000 per violation. With a firing or serious harm and a similar violation within five years, the cap would be $100,000. For lockout violations, penalties could reach $75,000 per violation, or up to $150,000 in similar repeat cases. These fines would be on top of any other remedy. The Labor Board would weigh gravity, employer size, history, and the public interest. Directors or officers could be fined personally in some cases.
