Low-Income Housing Tax Credit Elimination Act

Sponsored By: Representative Grothman, Glenn [R-WI-6]

Introduced

Summary

Sunsets the Low-Income Housing Tax Credit (LIHTC). This bill would eliminate the LIHTC for any building placed in service in a taxable year beginning after the date this provision becomes law, so projects that start service after enactment could not claim the credit. LIHTC determinations would still be possible for buildings placed in service before enactment. The bill includes no phase-in, transitional credits, or replacement funding mechanisms.

No new low-income housing tax credits

This bill would end new Low-Income Housing Tax Credits. Developers and investors could not claim the credit for buildings placed in service in taxable years that start after the enactment date. Projects placed in service in earlier taxable years could still claim credits under current rules. There are no phase-ins or transition rules. If passed, this could make new affordable housing harder to finance and could slow new units.
