Sponsored By: Representative Swalwell, Eric [D-CA-14]
Introduced
Summary
This bill would move the United States Marshals Service (USMS) into the judicial branch and rebuild its leadership and duties to make marshals answer to a Chief Justice‑appointed Director and a new Board.
Show full summary
- The Director and Board: It would create a Director appointed by the Chief Justice in consultation with a Board. The Board can remove the Director and set goals for the Service.
- District marshals and terms: The Chief Justice would appoint a marshal for each judicial district and the D.C. Superior Court. Marshals would serve four‑year terms and stay on until a successor qualifies.
- New authorities and cooperation: It would let the USMS provide personal protection for federal jurists, court officers, witnesses, and others when criminal intimidation disrupts judicial processes. It would also permit the Service, at the Attorney General's request and with the Director's approval, to investigate fugitives, issue administrative subpoenas for unregistered sex offenders, and assist in locating missing children.

Marshals help find fugitives and kids
If enacted, the Marshals could help the Justice Department hunt fugitives in the U.S. and abroad. The Attorney General would have to ask, and the USMS Director would have to approve. Marshals could issue administrative subpoenas only to investigate unregistered sex offenders. They could also help state and local police find and recover missing children.
Courts would run U.S. Marshals
If enacted, the U.S. Marshals Service would move into the judicial branch. The Chief Justice, with a Board, would appoint the Director and a marshal for each district and D.C. The Northern Mariana Islands marshal could serve another district at the same time. Marshals would serve four-year terms and stay on until a successor qualifies. Some powers would shift from the Attorney General or President to the Chief Justice and Board, and some Attorney General requests would need the Director’s approval.
More protection for judges and courts
If enacted, the Marshals could protect federal judges, court staff, witnesses, and others who are threatened. Protection would apply when criminal intimidation impedes a court or any official proceeding. The Homeland Security Act would list court protection as a mission to coordinate with the Marshals and the FBI.
